Terms and Conditions

These terms and conditions (T&Cs) for Schools and Parent Teacher Associations (PTAs) set out the agreement between the school or PTA which has registered on The Parents Lottery website and Parentkind Enterprise Ltd, a company incorporated in England and Wales (registration number 03884281) having its registered office at 71-75 Shelton Street, London, WC2H 9JQ and authorised as a Remote Operator by the Gambling Commission of GB (Remote Operator number: 000-057904-R-333479-002).

By registering with The Parents Lottery, you agree to be bound by these Terms and Conditions and that they will apply to the exclusion of any other terms and conditions.

1.     Definitions:

In these T&Cs, the following words mean the following:

‘’Agreement’ means the agreement between you and us as governed by these T&Cs.

‘’Applicable Laws’’ means all applicable laws, statutes, regulations and codes from time to time in force, including the Gambling Act 2005 (as amended from time to time) and the Data Protection Laws

‘Authorised person’ the person who has authority from your school or PTA to register the organisation as a beneficiary of The Parents Lottery

‘Beneficiary’ means a PTA or school as described below

‘Confidential Information’ means any and all information which relates to the business affairs, products, developments, trade secrets, know how, personnel, customers and suppliers of either party or which is marked ‘confidential’ or information which may reasonably be regarded as the confidential information of the disclosing party, save that Confidential Information will not include any information independently known to a party or is in the public domain, other than as a result of a breach of section 10 (Confidentiality).

‘Data Protection Laws’ means the UK GDPR, Data Protection Act 2018 (as amended from time to time) and any other law of the United Kingdom or a part of the United Kingdom which relates to the protection of personal data

‘Gross Ticket Receipts’ means the gross amount paid to us on a monthly basis from the purchase of Lottery chances by Members.

‘Intellectual Property Rights’’ means patents, rights to inventions, copyright and neighbouring and related rights, moral rights, trade marks and service marks, business names and domain names, rights in get-up and trade dress, goodwill and the right to sue for passing off or unfair competition, rights in designs rights in computer software, database rights, rights to use, and protect the confidentiality of, Confidential Information and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world,

‘Licence Conditions’ mean the Licence Conditions and Codes of Practice of the Gambling Commission or other relevant licencing authority applicable to us or you from time to time.

‘Lottery’ means a lottery promoted by Parentkind Enterprise Ltd and operated on behalf of Parentkind Enterprise Limited by CFP Lottery and Raffles Ltd (CFP)

‘Lottery Draw Date’ means the date of the first draw in which you have sold tickets to Members. All Lottery draws take place on a Friday (in the event of a Friday Bank Holiday, that week’s draw will be conducted on the next working day)

‘Member’ means any person who has paid the required amount to enable them to be entered into a draw of a Lottery and who will be and continue to be a Members until that person ceases to be a Member for whatever reason.

‘Member Personal Data’ the personal data of Members collected through their participation in the Lottery

‘The Parents Lottery’ means the Lottery, website and platform, located at www.theparentslottery.org

‘PTA’ means a Parent Teacher Association or school Parent Body or parent fundraising team associated with an educational establishment registered with the Department for Education in England or Wales or Education Scotland

‘School’ means a school registered with the Department of Education in England or Wales or Education Scotland

‘Share of Receipts’ means the share of the Gross ticket Receipts allocated to you, calculated as a percentage of the Gross Ticket Receipts.

‘UK GDPR’ has the meaning given to it in Section 3 (10) of the Data Protection Act 2018 (as amended from time to time)

1.     The Lottery
1.1  The Lottery is promoted by Parentkind Enterprises Ltd and administered on its behalf by CFP Raffles and Lotteries Ltd an ELM authorised by the Gambling Commission
1.2  Gross Ticket Sales are the property of Parentkind Enterprises Ltd
1.3  The Lottery raises funds for schools and PTAs who are registered as beneficiaries of the Lottery
1.4  Only registered beneficiaries will benefit from the Lottery’s Gross Ticket Sales
 
2.     Beneficiaries Lottery Registration
2.1  Your organisation must be a school or PTA as defined above
2.2  The school or PTA must have a UK bank account in your organisation’s name that we can deposit your ticket sales percentage and donation proceeds, for which you are named a beneficiary, via a BACS transfer. Ticket proceeds and donations will not be transferred to any other bank account other than one which matches the school or PTA name.
2.3  By registering as a beneficiary with the Lottery, you confirm that your school or PTA raises funds to benefit the education and well-being of children in the school and not for any third-party cause, whether charitable in status or not.
2.4  The person registering your school or PTA with the Lottery is authorised to do so and is the main point of contact for the Lottery. 
2.5  The ‘Authorised Person’ agrees to maintain the organisations details and to administer their organisations lottery page and make decisions on the organisation’s behalf in connection with the Lottery
2.6  You warrant that all information provided when registering is true and correct.
2.7  Parentkind Enterprises Ltd and/or it’s ELM, CFP Raffles and Lotteries, reserve the right to refuse or cancel your school or PTA’s registration at any time should you not meet the criteria to register, do not adhere to these T&Cs or bring either the Promotor, Administrator or the Lottery into disrepute.
2.8  Registration with the Lottery does not guarantee that your school or PTA will benefit from the Gross Ticket Sales
2.9  By registering with the Lottery you confirm your acceptance of these T&Cs.

3.     Term of Registration
3.1  A beneficiary’s registration will be considered valid on a rolling termly basis. There is no minimum or maximum registration term.
3.2  Should you wish to terminate your registration, you may do so by giving six weeks’ notice in writing to be sent to:

4.     Effects of Registration Termination
Upon termination of a beneficiary’s participation in The Parents Lottery:
4.1  Parentkind Enterprises Ltd will pay the beneficiary any unpaid Gross Ticket Sales percentage, within 14 days of the last day of term following termination as per Clause 8 of these T&C’s.
4.2  The beneficiaries account with the Lottery will be frozen and the beneficiary will not have access to the account
4.3  The beneficiary will cease to promote the Lottery 
4.4  The beneficiary will cease to use the Lottery promotional materials with immediate effect and return or destroy all such material(s) in its possession
4.5  The beneficiary’s Lottery page will no longer be visible on the Lottery website or any associated material
4.6  Members will be able to buy Chances in the Lottery but not specify the organisation as their chosen beneficiary nor give a donation to your organisation via the Lottery
4.7  The Lottery will write to Members who have chosen you as their beneficiary to notify them of your organisation’s registration termination. They will be given the option to choose another beneficiary or terminate their Chances inline with the Player T&C’s printed on the Lottery website
 
 
5.     Gross Ticket Sales
5.1  All Gross Ticket Sales remain the property of Parentkind Enterprises Ltd until they are dispersed at the discretion of Parentkind Enterprises Ltd. 
5.2  The Gross Ticket Sales are divided as follows:
(a)   For every £1 Chance purchased with you as the chosen beneficiary, the Gross Ticket Sales will be split as follows between 1st January 2025 and 31st December 2025
·       60% will go to the chosen beneficiary
·       18.18% towards prizes
·       21.82% for administration of the Lottery
(b)   From 1st January 2026 until further notice, Parentkind Enterprises Ltd will alter the split of Gross Ticket Sales as follows or another structure:
 
·       60% will go to the chosen beneficiary who retains PTA Membership by Parentkind for the school term in which the draws are held
OR
·       50% will go to the chosen beneficiary who does not retain PTA Membership by Parentkind, or who is a school, for the school term in which the draws are held
·       18.18% towards prizes
·       21.82% for administration of the Lottery
5.3  Should Chances be purchased with Parentkind as the beneficiary, Parentkind reserves the right to distribute 60% of the Gross Ticket Receipts to Good Causes as determined at the time of distribution
5.4  Should a registered beneficiary, who at the time of registration held a PTA Membership with Parentkind r, not renew their subscription with Parentkind they may continue with their Lottery registration. However, as a beneficiary their Gross Ticket Sales percentage will be reduced to 50% from the second year and subsequent years of the Lottery operating, unless5.5 applies. The reduction will be applied up to six (6) weeks after the PTA Membership by Parentkind has ceased. This clause does not apply to schools who should refer to 5.2
5.5  Should a registered beneficiary fail to renew their Membership with Parentkind on their due date but subsequently renews their subscription at a later date (not exceeding 30 days), they will receive 50% of the Gross Ticket Receipts between their failed renewal date and up to six weeks after their renewal is processed by Parentkind. Should they renew 30 days after their renewal date 5.6 will apply. This clause does not apply to schools who should refer to 5.2?
5.6  Should a registered beneficiary not hold PTA Membership by Parentkind at the time of Lottery registration but subsequently subscribes to PTA Membership by Parentkind, then the Gross Ticket Sales percentage will be applied at 60%. This will be applied up to six weeks after the PTA Membership by Parentkind is processed and will not be back dated. This clause does not apply to schools who should refer to 5.2
5.7  There are not alternative payment options available

6.     Beneficiary Selection
6.1  Once registered with the Lottery, the beneficiary will be searchable by school name or school post code on the Lottery website.
6.2  Members will be able to select a registered beneficiary as their preferred recipient for Parentkind Enterprises Ltd to pay 60% or 50% of the Gross Ticket Receipt to.
6.3  Members may choose to select as many beneficiaries as they wish to.
6.4  Members may only select one beneficiary against an individual lottery ticket

7.     Donations
7.1  When purchasing a Lottery ticket, Members will be given the opportunity to top up their ticket purchase with a regular or singular donation to their preferred beneficiary.
7.2  Any donation in support of a beneficiary will be collected by Parentkind Enterprises Ltd
7.3  Payment of donations will be made in line with payment of the appropriate Gross Ticket Sales percentage as set out in 5.2 and Clause 8
7.4  Where the Member choses to complete a Gift Aid declaration, the Gift Aid claimant will be Parentkind (Registered Charity No: 1072833) and no collected Gift Aid, or a portion of the Gift Aid, will be given to the chosen beneficiary. This is made clear to Members who select the Gift Aid option.
7.5  Any Gift Aid collected by Parentkind will be used to further Parentkind’s charitable objectives.

8.     Payment
8.1  Payment of the appropriate Gross Ticket Sales and Donations will only be made into a bank account in the name of the beneficiary.
8.2  Payments will be made by BACS transfer only
8.3  Payment will be made within 14 days of the last day of term as decided by Parentkind
8.4  The last day of term for the 2025-2026 calendar year will be:
(a)   (a) 4th April 2025
(b)   (b) 22nd July 2025
8.5  (c) 19th December 2025
8.6  Any payments due for August of each year will be included in the December payment
8.7  Payment dates will be updated yearly and printed in an updated version of these T&C’s and published on the Lottery website
8.8  Parentkind Enterprises Limited reserve the right not to distribute funds to beneficiaries who have:
(a)   Not adhered to these T&C’s
(b)   Be found to bring Parentkind Enterprises Ltd, Parentkind, Parentkind Trading Ltd or The Parents Lottery into disrepute
(c)    Allowed the lottery to be promoted by or to anyone under the age of 18
(d)   Engaged in any activity deemed illegal by the courts in England and Wales or Scotland and/ or set out in legislation whether enacted by the UK Parliament or devolved legislation enacted by the Scottish Parliament or any other devolved administrations
(e)   Found to have entered into any activity, either knowingly or unknowingly, which either/or is contra to the Gambling Act 2005 (as amended from time to time) and/or any regulations set out by the Gambling Commission

9.     Protection of Funds
9.1  We are required by our licence to inform customers about what happens to funds which we hold on account for you in the event of insolvency. The Gambling Commission provides further information on our licence conditions detailing what we need to tell customers about their funds.

10.  We hold customer funds separate from company funds. These funds are not protected in the event of insolvency: not protected segregation. For more information, please see the customer funds insolvency ratings system

Marketing Materials
10.1        Only marketing materials provided or authorised by Parentkind Enterprises Ltd may be used in the promotion of The Parents Lottery
10.2        Promotional materials remain the property of Parentkind Enterprises Ltd
10.3        Promotional materials provided by Parentkind Enterprises Ltd may not be used for any reason other to promote The Parents Lottery
10.4        As prescribed in 4.3 and 4.4 above, upon termination of registration in The Parents Lottery your organisation will cease to use any promotional materials provided by Parentkind Enterprises Ltd with immediate effect

11.  Liability

11.1 Neither CFP, Parentkind Enterprises Ltd or any of the Beneficiaries participating in the Lottery from time to time shall be liable to you for any loss or damage suffered by you arising from:

(a) Any delays or failures in the postal service or other delivery methods used by CFP, Parentkind Enterprises Ltd or you from time to time

(b) Any delays or failures in any systems used by CFP, Parentkind Enterprises Ltd, Parentkind or you to transmit emails

(c) Any failure in any software of other systems used by CFP, Parentkind Enterprises Ltd or Parentkind for the administration of the Lottery

(d) Any delays or failures in the banking system used by CFP, Parentkind Enterprises Ltd or you

(e) Any refusal by CFP to accept registration of an individual as a Member or the cancellation of a Member by CFP

 (f) Any event beyond the reasonable control of CFP and Parentkind Enterprises Ltd

11.2 Neither CFP, Parentkind Enterprises Ltd or any of the beneficiaries participating in the Lottery from time to time shall be liable to you in contract, tort, negligence or otherwise for any indirect or consequential loss suffered by you in relation to your participation in the Lottery (including loss of the opportunity to enter the Lottery, it’s Draws and/or the chance of winning a prize)

12. Intellectual Property Rights

12.1  Parentkind Enterprises Ltd own all Intellectual Property Rights in The Parents Lottery and all marketing materials provided to the organisations through TheParents Lottery or directly from Parentkind Enterprises Ltd or Parentkind

12.2        Parentkind Enterprises Ltd do not own the beneficiaries Logo but you give permission for this to be included on our marketing materials for The Parents Lottery and use on The Parents Lottery website. 
12.3        Parentkind Enterprises Ltd give registered beneficiaries permission to use the marketing materials provided for the promotion of The Parents Lottery in Great Britain
12.4         
Parentkind Enterprise Ltd warrant that The Parents Lottery and marketing materials that we may provide for the beneficiaries’ use (excluding the beneficiaries branding) do not infringe the rights, including any Intellectual Property Rights, of any third party
12.5        Your organisation gives us a non-exclusive and royalty-free licence to use your logo and any materials that you provide to us for the promotion of The Parents Lottery in Great Britain
12.6        Your organisation warrant that your logo and any materials that you provide to us do not infringe the rights, including any Intellectual Property Rights, of any third party

12.6  Only marketing materials provided or authorised by Parentkind Enterprises Ltd may be used in the promotion of The Parents Lottery

12.7 Promotional materials remain the property of Parentkind Enterprises Ltd

12.8 Promotional materials provided by Parentkind Enterprises Ltd may not be used for any reason other to promote The Parents Lottery

12.9 As prescribed in 4.3 and 4.4 above, upon termination of registration in The Parents Lottery your organisation will cease to use any promotional materials provided by Parentkind Enterprises Ltd with immediate effect

13. Data Protection

Privacy

13.1 Parentkind Enterprises Ltd will collect and process beneficiary and personal information in order to conduct the weekly Lottery and it will be shared with Parentkind Enterprise Ltd’s agents to the extent necessary for the weekly Lottery to be administered. 

13.2 Names and other personal details from Lottery registration will be collected and sorted by Parentkind Enterprises Ltd’s parent company, Parentkind, and held in accordance with the applicable privacy policy in place from time to time.

13.3 Parentkind Enterprises Ltd and/or Parentkind will send beneficiaries marketing material, information and invitations to take part in research outside the scope of the Lottery, that they have explicitly consented to receive.

13.4 Parentkind Enterprises Ltd and Parentkind will remain the Data Controller at all times

13.5 Parentkind Enterprises Ltd and Parentkind will not share Members personal data with the beneficiaries registered with the Lottery

13.6 CFP will, in conjunction with Parentkind Enterprises Ltd and Parentkind, be a Data Processor for the Lottery

13.7 Our Privacy Policy can be found on our website www.theparentslottery.org

14. Confidentiality

14.1 During the registration period, and for a period of five (5) years after registration termination, neither party will disclose to any person or legal entity, any Confidential Information of the other party or its group companies, except as permitted by law and;

14.2 Confidential Information may be disclosed by a party 

(a) to its employees, officers, representatives, contractors, subcontractors or advisers or those of its group companies, who need to know such information for the purposes of exercising the part’s rights or carrying out its obligations under or in connection with these T&Cs. Each Party will ensure that its Representatives, to whom it discloses the other party’s Confidential Information comply with Section 14

(b) As may be required by Applicable Laws, a court of competent jurisdiction, any governmental or regulatory authority ort he rules of a relevant stock exchange.

14.3 No Party will use the other party’s Confidential Information for any purpose other than to exercise its rights and perform its obligations under or in connection with these T&Cs

12     Force Majeure

Parentkind Enterprises Limited will not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform any of its obligations under these Terms and Conditions due to delay or failure resulting from events, circumstances or causes beyond our reasonable control.
